Time to take advantage of the land amnesty!

Every land plot must have a document. The change in legislation as of September 1, 2022, provided an opportunity for individuals who have engaged in unauthorized occupation of land plots to take advantage of the so-called land "amnesty" until January 1, 2028.

Unauthorized occupation of a land plot is understood as its use without a title document, which is expressed in the construction of a capital structure entirely on the land plot of another land user or on common use lands. Unauthorized occupation of part of a land plot also includes the construction, reconstruction of a capital structure, fencing, which is an integral part of it, and the improvement of the adjacent territory of the capital structure, which results in a violation of the boundary of the provided land plot, and the use of the land plot for growing agricultural products (gardening).

In order to formalize the right to an unauthorizedly occupied land plot, the land user must contact the local executive committee at the location of the land plot.

An unauthorizedly occupied land plot can only be legalized if a number of conditions are met. One of the conditions is that the preservation of the constructed, reconstructed capital structure (building, construction) does not entail significant violations of urban planning and construction norms and rules, and there must also be consent from adjacent land users (land users of the occupied land plot (part of the land plot) — in case of its unauthorized occupation) for the preservation of the constructed, reconstructed capital structure (building, construction) and the change of land plot boundaries.
In addition, there must be no ongoing court dispute regarding the object of unauthorized construction and/or the land plot, as well as the absence of an unfulfilled court ruling (enforcement document) obligating to perform certain actions regarding the object of unauthorized construction and/or the land plot.

It should also be noted that the land amnesty only applies to facts of unauthorized construction recorded before September 1, 2022.  The interested party must documentally confirm that the unauthorized construction appeared before this period.

After January 1, 2028, decisions regarding unauthorized construction will be made in accordance with the provisions of Article 223 of the Civil Code of the Republic of Belarus, which states that unauthorized constructions on unauthorizedly occupied land plots are subject to demolition, land plots are to be brought into a condition suitable for use for their intended purpose and returned to the former land user, while citizens may be held administratively liable.  

Dear residents of the district, if you know that you have violations on your land plot, we ask you to start organizing the title documents now. To begin with, the interested party in legalizing the land plot must contact the land management department of the Orsha district executive committee at the address: Orsha,
