Attention taxi drivers
INSPECTION OF THE MINISTRY OF TAXES AND CHARGES OF THE REPUBLIC OF BELARUS FOR THE ORSHA DISTRICT
Tax authorities draw the attention of DRIVERS, who directly provide services in the field of passenger transportation by taxi cars, to the mandatory compliance with the procedure for accepting payment methods when providing services.
According to paragraph 164 of the Rules for Passenger Transportation by Road, approved by the resolution of the Council of Ministers of the Republic of Belarus dated 30.06.2008 No. 972 "On Certain Issues of Passenger Transportation by Road" and paragraph 4 of the Regulation on the Use of Cash and Other Equipment for Accepting Payment Methods, approved by the resolution of the Council of Ministers of the Republic of Belarus and the National Bank of the Republic of Belarus dated 06.07.2011 No. 924/16, upon completion of the trip, the passenger
of the taxi car is ISSUED A PAYMENT DOCUMENT (hereinafter - RECEIPT)
For violation of the procedure for accepting payment methods, the guilty person is subject to administrative liability under Article 13.14 of the Code of the Republic of Belarus on Administrative Offenses in the form of a fine of up to thirty basic units.
In this regard, in the case of accepting cash from the passenger without using cash equipment, administrative liability arises primarily for YOU - DRIVERS! In addition, repeated (twice or more within 12 consecutive months) violations of the established procedure for accepting payment methods are grounds for excluding the DRIVER from the "Register of Passenger Transportation in Irregular Communication" (hereinafter - the Register).
At the same time, according to paragraph 10 of part 1 of Article 28 of the Law of the Republic of Belarus dated 14.08.2007 No. 278-3 "On Road Transport and
Road Transportation", paragraph 9 of point 169 of the Rules No. 972, the passenger of the taxi car has the right to refuse to pay for the trip in case of providing the transportation service with faulty, turned off (blocked) software cash register for taxis or cash summing device combined with a taximeter (except in cases of performing passenger transportation by taxi cars ordered and paid through an electronic information system only using the details of bank payment cards).
Thus, the passenger has the right NOT TO PAY for the trip in case of malfunction of the cash equipment, or when it is not turned on, and, accordingly, there is no possibility of receiving a RECEIPT!
In addition, the road carrier, the vehicle, the driver of the vehicle, the taxi dispatcher in accordance with the Decree of the President of the Republic of Belarus dated 25.01.2024 No. 32 "On Passenger Transportation" must be included in the Register
For carrying out transport activities without being included in the Register, the guilty persons are subject to administrative liability under part 3 of Article 13.3 of the Code of the Republic of Belarus on Administrative
Offenses.
