Employer liability for foreign workers has been introduced in Belarus by a presidential decree.
The President of Belarus, Alexander Lukashenko, signed decree No. 202 "On Increasing the Role of Employers in the Field of External Labor Migration" on May 21, which establishes the responsibility of employers for foreign workers. This was reported by BELTA from the press service of the head of state.
To strengthen the requirements for attracting foreign labor, with the exception of citizens of EAEU member states, additional obligations are imposed on employers. These include visiting migrants at home to study living conditions, taking measures to eliminate identified violations if necessary, and informing the competent state authorities, as well as organizing mandatory testing of migrants for knowledge of the Russian or Belarusian language.
It will be necessary to conclude an employment contract with the migrant within 30 days from the date of their entry into Belarus. At the same time, temporary transfer of such a worker to another employer is prohibited to avoid using their labor without following the established procedure for attracting foreign specialists.
Employers will also be required to organize control over the activities and living conditions of migrants, including identifying individuals responsible for such control.
Failure to fulfill their obligations will result in administrative liability for employers, and for migrants - early termination of the employment contract and departure from the country.
