Electronic appeals

ATTENTION

In connection with the entry into force on 02.01.2023 of the Law of the Republic of Belarus dated 28.06.2022 No.176‑Z “On amendment of the Law of the Republic of Belarus ‘On appeals of citizens and legal entities’”, please note the following changes.

Since 02.01.2023, electronic appeals are understood as appeals submitted by applicants through the state unified (integrated) republican information system for accounting and processing appeals of citizens and legal entities (hereinafter – the system of accounting and processing appeals).

The system of accounting and processing appeals is an information system intended for submitting electronic appeals to state bodies and other state organisations and receiving responses (notifications) to them, as well as for processing electronic appeals, responses (notifications) to them, electronic copies of responses (notifications) to written appeals, other information about the consideration of appeals, and about leaving appeals without substantive consideration.

In connection with the above, from 02.01.2023, in case electronic letters from citizens or legal entities arrive at the Investigative Committee units bypassing the system of accounting and processing appeals, such letters will not be registered and processed as electronic appeals.

We also draw the attention of website visitors to the provisions of Article 2 of the Law of the Republic of Belarus “On appeals of citizens and legal entities”, according to which the action of this law does not apply to appeals that are to be considered under criminal procedural legislation. Considering the tasks performed by the Investigative Committee in the field of pre‑trial criminal proceedings, we inform that the submission of statements on crimes, complaints and motions in criminal cases, investigation materials by sending electronic appeals (including via the system of accounting and processing appeals) is not provided for by the Criminal Procedure Code of the Republic of Belarus (hereinafter – CPC). Such statements, complaints and motions according to Articles 136, 139 and 168 of the CPC are submitted to the Investigative Committee units in writing or orally (in the latter case – entered into the protocol).

Procedure for submitting electronic appeals:

  • Electronic appeals to the Investigative Committee are submitted via the state unified (integrated) republican automated system for accounting and processing appeals of citizens and legal entities.
  • The electronic appeal is presented in Belarusian or Russian.
  • The appeals must contain information about the results of their previous consideration with attached (if available) documents confirming this information.
  • Electronic copies of documents confirming the authority of the applicants must be attached to electronic appeals submitted by representatives of the applicants.
  • If the requirements for the form and content of electronic appeals are not met, or if the electronic copies of documents confirming the authority of the applicants' representatives are not attached, electronic appeals may be left without substantive consideration.
  • Responses (notifications) to electronic appeals are sent through the system of accounting and processing appeals, except when the applicant requests a written response in his electronic appeal.
  • The applicant has the right to withdraw his electronic appeal before its substantive consideration by submitting an appropriate written or electronic statement.

The organization’s answer to an appeal or a decision to leave an appeal without substantive consideration after appeal to a higher organization, as well as the answer or decision to leave an appeal without substantive consideration of an organization that has no higher organization, may be appealed to the court in the procedure established by law.

If written and/or electronic appeals of identical content from different applicants are received in a mass manner (more than ten appeals), answers to such appeals by decision of the head of the Investigative Committee unit or the person authorized by him to sign responses may be posted on the official website of the Investigative Committee without sending answers (notifications) to the applicants. After posting such an answer (notification) on the official website, subsequent written and/or electronic appeals of identical content are not considered and answers (notifications) to them are not sent to the applicants.

Requirements for the content of electronic appeals

Electronic appeals of citizens must contain:

  • the name and/or address of the organization or the position and/or surname, given name, patronymic (if any) or initials of the person to whom the appeal is addressed;
  • surname, given name, patronymic (if any) or initials of the citizen, address of his place of residence (stay);
  • the substance of the appeal;
  • the citizen’s e‑mail address.

Electronic appeals of legal entities must contain:

  • the name and/or address of the organization or the position and/or surname, given name, patronymic (if any) or initials of the person to whom the appeal is addressed;
  • the full name of the legal entity and its location;
  • the substance of the appeal;
  • surname, given name, patronymic (if any) or initials of the head or the person authorized in the established procedure to sign appeals;
  • the legal entity’s e‑mail address.
