On the features of construction and acceptance of facilities into operation

The President of Belarus, Alexander Lukashenko, signed Decree No. 46 "On the Features of Construction and Acceptance of Facilities for Operation" on January 31. According to the document, the construction of facilities classified as fourth and fifth complexity classes (according to the classification established by the construction norms of Belarus) by legal entities is significantly simplified.

The acceptance of such facilities, constructed according to repeatedly used projects or projects that have undergone state construction expertise, will be carried out only on the basis of the conclusion of state construction supervision bodies without obtaining conclusions from other supervisory bodies.

Customers are granted the right to build (erect, reconstruct, modernize) the specified facilities based on drawings sufficient to confirm compliance with safety requirements and a sketch project approved by the local executive committee's architecture department.

The composition and volume of the necessary drawings are determined by the customer independently. The procedure for agreeing on the sketch project and its composition will be established by the Government.

The decree eliminates the need to obtain permitting documentation, develop pre-project and project documentation, and conduct its expertise (construction, environmental, and others).

The main conditions for applying the simplified construction procedure are the presence of a land plot provided in the established manner by the customer, and the purpose of the constructed facility must correspond to the approved general plan for the development of the territory.

In order to ensure the safety of the constructed facilities, the decree provides for a special procedure for their acceptance for operation, taking into account the requirements of environmental and fire safety and construction norms.

The norms of the decree regarding the simplified procedure for the acceptance of facilities for operation come into force after its official publication.
