Lukashenko signed the decree "On Insurance". We tell you about the main innovations
The President of Belarus, Alexander Lukashenko, signed decree No. 108 "On Insurance" on March 18. The document aligns certain legislative acts with the law "On Insurance Activities," which comes into force on January 1, 2025, as reported by BELTA in the press service of the head of state.
In particular, a number of decrees (their individual structural elements) are recognized as having lost force, the provisions of which are reflected in the law. The terminology used in legal acts, including in related legislation (tax, currency, banking, in the field of road traffic), is adjusted for consistency with the law's prescriptions.
Among the innovations of the decree is the provision for the possibility of paying insurance premiums (making payments) in non-cash form using modern payment methods; the establishment of insurance sums and the amounts of insurance premiums for mandatory insurance of vehicle owners and health insurance for temporarily residing foreign citizens in basic units (previously in euros).
In addition, the contract for mandatory insurance of civil liability of vehicle owners is supplemented by the existing union insurance contract in Belarus and Russia.
The procedure for insurance payments to victims of traffic accidents is defined in cases where the carrier has not concluded a contract for mandatory liability insurance to passengers and it is impossible to recover damages through the courts. In the case of payments to drivers from guarantee funds, harm to life or health resulting from a traffic accident involving wild animals is added, regardless of the driver's fault.
The decree provides for the possibility of making insurance compensation payments to a non-resident in foreign currency under the civil liability insurance contract of a resident for an export contract.
For mandatory insurance against accidents at work and occupational diseases, maximum amounts that can be recovered by "Belgosstrakh" from those responsible for causing harm to insured persons in the amount of paid insurance compensation are established (in cases of intentional harm - 2,000 basic units, without intent - 500). The conditions for the policyholder to obtain a deferral for the payment of overdue insurance premiums, fines, and penalties are simplified.
The decree also introduces a number of restrictions on the activities of insurance intermediaries.
