Question 1. Is the use of pyrotechnic devices (regardless of their purpose) in buildings, structures and premises, including on stage, on the territory of the Republic of Belarus?

In accordance with paragraph 21 of the general fire safety requirements for the content and operation of capital structures (buildings, constructions), isolated premises and other objects owned by economic entities, approved by the Decree of the President of the Republic of Belarus dated November 23, 2017 No. 7 “On the Development of Entrepreneurship” (hereinafter — the general fire safety requirements), the use of pyrotechnic devices (regardless of their purpose) and open flame (candles, torches and other fire effects) is not permitted in buildings, structures and premises.

At the same time, paragraph 18 of the general fire safety requirements stipulates that the organization of cultural events and film production on open sites using open fire, pyrotechnic devices and fireworks must be carried out in accordance with the approval of the head of the economic entity.
by a plan of organizational and technical measures to ensure fire safety in the preparatory period and the implementation period
the specified measures.

Furthermore, in accordance with paragraph 3 of clause 53 of the Rules for ensuring industrial safety when handling pyrotechnic products, the conduct of a fireworks display is not permitted in buildings, structures, and premises.

Thus, the use of pyrotechnic devices (regardless of their purpose) in buildings, structures and premises is not permitted, including on a stage if it is placed inside a building, structure or premises.

      In case the stage is not placed inside a building, structure, or premises, the use (operation) of pyrotechnic products (regardless of their purpose) is permitted in accordance with the requirements of the operational documentation or with technological instructions (technological processes) approved in the prescribed manner, developed taking into account fire safety requirements defined in accordance with fire safety regulations according to the current legislation of the states—members of the Customs Union.

Question 2. Are fireworks displays or other spectacular events involving the use of technical pyrotechnic devices permitted (regardless
from the hazard class), in the territory of the Republic of Belarus legal entities that do not have permission (license)?

In accordance with the Customs Union technical regulation “On the safety of pyrotechnic products” TR TS 006/2011, legal entities that have a permit (license) for this type of activity, in accordance with the legislation of the member state of the Customs Union whose territory the fireworks display or other spectacular event involving the use of pyrotechnic products of a technical purpose is held, are allowed to conduct fireworks shows or other spectacular events.

Also, the Rules on ensuring industrial safety when handling pyrotechnic products establish that legal entities that have a permit (certificate) for the right to conduct fireworks displays using pyrotechnic products of technical purpose of classes IV and V of danger are allowed to carry out a fireworks show using pyrotechnic products of technical purpose in accordance with the Customs Union technical regulation “On the safety of pyrotechnic products” TR TS 006/2011,
issued by Gospromnadzor.

Thus, legal entities that do not have a permit (certificate) issued by the State Industry Supervision Service cannot be allowed to conduct fireworks displays.

Question 3. Which state body is authorized to carry out control (supervision) over the circulation (sale, use, storage) of pyrotechnic products of a technical nature (regardless of hazard class) on the territory of the Republic of Belarus?

According to the Decree of the President of the Republic of Belarus of February 9, 2015 No. 48 «On measures to ensure state control (supervision) over
with compliance with the requirements of the technical regulations» and the resolution of the Council of Ministers of the Republic of Belarus of June 24, 2015 No. 529 «On authorized (competent) bodies of the Republic of Belarus for carrying out state control (supervision) over compliance with the requirements of the technical regulations of the Customs Union, the Eurasian Economic Union» authorized (competent) bodies of the Republic of Belarus, responsible for carrying out state control (supervision) over compliance with the requirements of the Customs Union technical regulation «On the safety of pyrotechnic products» TR TS 006/2011, are defined as the Ministry of Emergency Situations of the Republic of Belarus and the State Committee for Standardization of the Republic of Belarus:

Ministry of Emergency Situations — state supervision of compliance with the technical regulations of the Customs Union, the Eurasian Economic Union in the field of fire and industrial safety.

       State Committee for Standardization of the Republic of Belarus — state control (supervision) over compliance with the requirements of the technical regulations of the Customs Union, the Eurasian Economic Union and indicators not included in the technical regulations of the Customs Union, the Eurasian Economic Union, but
declared by the manufacturer (seller, supplier, importer) of the product in supply (sale) contracts, in its labeling or operational documentation.

Accordingly, in accordance with the Regulation on the Department for Supervision of Safe Work Conduct in Industry of the Ministry of Emergency Situations of the Republic of Belarus, approved by the Decree of the President of the Republic of Belarus dated November 14, 2022 No. 405, and the Law of the Republic of Belarus dated January 5, 2016 No. 354-3 “On Industrial Safety”, state supervision over the implementation of activities in the field of industrial safety related to the storage of pyrotechnic products of any purpose (excluding storage at warehouses of retail trade objects) and the use of pyrotechnic products of classes IV and V of hazard, is carried out.
The State Industrial Supervision Service. Also, within its competence, the State Industrial Supervision Service carries out state supervision of compliance with the requirements of TR TS 006/2011 in the field of industrial safety (including
established by the Rules on ensuring industrial safety in the handling of pyrotechnic products concerning the processes of sale and storage of technical pyrotechnic products and the use of pyrotechnic products of classes IV and V hazard).
